Concussion

How did you hit your head?

 

Here are some of the many fact patterns of Acquired Brain Injury for which I have been the attorney:

 

  • You were involved in a car accident and your head hit the dashboard due to a head on or rear end collision.
  • You were riding your motorcycle, with or without a helmet, and a driver not paying attention ran the stop sign.

  • Your child hit her head on the side of the pool when at a birthday party, showing her friends how she could somersault into the pool.
  • You tripped over something that wasn't usually there.
  • You misjudged your step because of a poorly lit area.

 

A brain injury attorney, like myself, will review medical records, MRI films and other test results with the assistance of a team of medical experts. I will send out an investigator to take photographs and collect statements of any witnesses to the accident.

How are you feeling, or what are friends and family saying to you about your behaviour? Not all mild traumatic brain injury symptoms develop immediately after injuring your head; some are likely to develop after only a few days or weeks later and this is defined as post concussion syndrome.

 

Symptoms of concussion and post concussion syndrome:

 

  • Headaches
  • Not being able to concentrate well for long periods at a time
  • Not retaining information read or heard
  • Not remembering things you used to
  • Having less energy and feeling tired a lot of the time
  • No get-up-and-go - "I don't feel like doing anything."
  • Not being interested in your usual favourite activities and hobbies
  • Feeling irritable
  • Bright light and certain or loud sounds irritate you
  • Bursts of temper - "I can't take it anymore!"
  • Finding it difficult to solve small problems
  • Keeping quiet instead of communicating
  • Impulsive behaviour is embarrassing you or your friends when you're in a public place or social environment
  • Uncontrollable selfishness or consideration for others
  • A poor self image
  • Feeling depressed and miserable
  • Feeling dizzy and off balance and not walking steadily
  • Feeling foggy
  • Feeling nauseous
  • Slow to make decisions
  • Speaking more slowly
  • You become confused easily
  • Not sleeping well or sleeping at odd times of the day
  • Your vision is a little blurred
  • Things don't taste or smell like they used to or you can't taste or smell at all
  • A ringing sound in the ears - tinnitus

 

It is obvious that a mild TBI is somewhat more serious than a mere "bump on the head". An insurance company adjuster may try to pass the injury off as just a "bump on the head" but I am experienced in explaining the consequences of a concussion to an insurance company adjuster.

 

You're feeling the way you do, or functioning the way you are, because either the frontal lobe or temporal lobes of your brain have been injured. Sometimes the inner ear may be affected too when the tiny little crystals in the inner ear are dislodged from their usual positions. These tiny crystals give the brain information about the position of your head and body, and when they are knocked out of position can cause you to experience balance and dizziness problems.

 

The frontal lobe of your brain is situated directly beneath your forehead and damage to the frontal lobe is associated with many of the symptoms of concussion including problems such as:

 

  • Not being able to realise the consequences of actions
  • Not stopping yourself from making inappropriate comments during conversation in a social environment
  • Having trouble with telling the difference between right and wrong, or appropriate and inappropriate actions.

 

The temporal lobes of the brain are situated on the sides of your head a bit above your ears and damage to the temporal lobes interferes with your ability to function normally, such as with:

 

  • Development of long-term memory
  • Recognizing, categorising and identifying objects, faces, names and places
  • Properly processing what you see and hear
